At BearTransfers, we value creativity and are committed to respecting intellectual property rights. Our platform allows customers to upload their own artwork, images, and designs to be printed using high-quality DTF and UV DTF technology for personal or commercial use.
These Terms of Service outline the rules and expectations for using our Services, as well as your responsibilities as a customer, especially regarding copyright compliance, intellectual property ownership, and proper product usage. By accessing or using BearTransfers’ Services, you agree to comply with these terms.
User Responsibilities
Content Ownership
By uploading any artwork, logo, image, text, or design to BearTransfers, you represent and warrant that you either:
- Own all necessary rights to the content, or
- Have obtained full authorization, license, or permission from the rightful owner to use, reproduce, print, and distribute that content.
Indemnification
You agree to indemnify, defend, and hold harmless BearTransfers.com, its owners, affiliates, employees, and partners from and against any claims, liabilities, damages, losses, costs, and expenses, including legal fees, arising out of or related to any content you upload, submit, print, reproduce, sell, or distribute through our Services, including but not limited to intellectual property disputes.
Prohibited Content
You may not upload, submit, or request the printing of any content that:
- Infringes any copyright, trademark, patent, trade dress, or other intellectual property right;
- Is illegal, fraudulent, defamatory, threatening, abusive, obscene, hateful, or otherwise inappropriate;
- Promotes violence, discrimination, harassment, or unlawful activity;
- Violates the rights of any third party, including rights of privacy or publicity.
BearTransfers reserves the right to reject, cancel, remove, or refuse any order or uploaded content at its sole discretion if we believe it may violate these Terms or expose us to legal or reputational risk.
Intellectual Property
Respect for Rights
BearTransfers respects the intellectual property rights of others and expects all customers to do the same. You may not upload or submit any content that infringes or misuses another party’s protected materials.
Infringement Claims
If we receive a complaint, notice, or claim that any submitted or printed content may violate a third party’s intellectual property rights, we may investigate the matter, suspend production, cancel the order, remove the content, or restrict access to our Services without prior notice. Repeat violations may result in account suspension or permanent termination.
Product Use and Application
All products sold by BearTransfers are custom-made and intended to be applied using proper equipment, materials, settings, and methods. Final results may vary depending on heat press quality, pressure, temperature, peeling method, garment type, surface compatibility, storage conditions, and handling.
It is the customer’s responsibility to test products where appropriate and to ensure that recommended application and care instructions are followed correctly. BearTransfers is not responsible for issues caused by improper application, incorrect settings, unsuitable materials, misuse, or failure to follow our instructions.
Limitation of Liability
BearTransfers shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to lost profits, lost revenue, lost business opportunities, loss of goodwill, or claims arising from the use, misuse, resale, delayed delivery, or inability to use our products.
Our total liability for any claim relating to an order shall be strictly limited to the amount paid for the original order placed directly with BearTransfers.
We do not accept liability for any claims, losses, costs, or damages involving third parties, including end customers, resellers, marketplaces, or downstream business relationships.
Any issue with an order must be reported directly by the original purchaser within 7 days of delivery and must include clear supporting photo or video evidence. Claims submitted after this period, or claims made by third parties, may be denied.
Order Refusal and Service Access
BearTransfers reserves the right to refuse service, cancel orders, limit quantities, or suspend access to the website or Services at any time, with or without notice, where necessary to protect the business, comply with the law, or enforce these Terms.
Policy Updates
BearTransfers reserves the right to update or modify these Terms of Service at any time. Any changes will become effective upon posting on this page unless otherwise stated. Continued use of our Services after such changes constitutes acceptance of the revised Terms.
